Josh Duggar granted bail despite charges in “top five worst of the worst” child porn cases

’19 Kids and Counting’ star Josh Duggar is to be released from jail while he awaits his trial on child pornography charges.

He is to be released even though Homeland Security Investigations Special Agent Gerald Faulkner described the material he found on Duggar’s computer to be “in the top five of the worst of the worst that I’ve ever had to examine.” Faulkner couldn’t even mention the names of the files containing the heinous material.

Judge Christy Comstock in U.S. District Court for the Western District of Arkansas though “reluctantly” granted him bail. He is set to be released today.

Reality TV star Josh Duggar filed a motion Wednesday to be released from custody ahead of a trial where he faces child pornography charges.

In the motion, Justin K. Gelfand and Travis W. Story, Duggar’s attorneys, write that their client has never been convicted of a crime and has known about the investigation for a year and a half since federal investigators first conducted a search warrant at his former employer. According to the motion, Duggar and his family, six kids and a wife pregnant with child number seven, have remained in Arkansas since and Duggar has cooperated with authorities every step of the way.

Duggar’s “deep roots” in his community are cited as reason for why he is not a flight risk.

Duggar, 33, who appeared on TLC’s “19 Kids and Counting” from 2008 until 2015, was arrested April 29 and was arraigned the next day on federal charges of receipt and possession of child pornography after allegedly downloading material that depicted the sexual abuse of children under the age of 12, according to the US Attorney’s Office in the Western District of Arkansas.

Duggar pleaded not guilty to both charges (receipt and possession).

The show “19 Kids and Counting” was canceled in 2015 amid allegations that Duggar had molested girls when he was a teenager. He was never charged.

Judge Erin L. Wiedemann scheduled Duggar’s trial for July 6 at last week’s arraignment. During that court appearance, Judge Wiedemann set Duggar could not reside anywhere with minor children if he is released.
